Scope of Works
The Scope is to be as detailed on the drawings provided by the
Employer and priced within the lump sum stated in 2.1 below.
1.0 Programme
1.1 All Contract works contained within current programme __ and any
additions thereto shall take priority over the =====.
1.2 =====shall not commence until the completion and formal Taking
Over of the by the Employer of
1.3 Time for Completion date for the will be extended to the date of
the completion of the =====.
1.4 Individual sections shall be Taken Over individually by the
Employer upon completion. Defects
Liability periods shall commence from the date of the individual Take Over
certificates.
1.5 Delay Damages will apply to the =====only. The date for the
application of Delay Damages to shall be amended to the date in 1.3 above.
2.0 Payment Conditions
2.1 Employer will nominate the Subcontractor who will subcontract on
fixed lump sum on (with amendments see 3.3) standard nominated subcontractor conditions
included within the Contract Particular Conditions. Milestones for payment
purposes to be agreed.
2.2 Contractor will be entitled to an attendance fee of ……………% which
will be applied to the final account sum of the subcontract works.
2.4 Employer to make arrangements with =====to ensure all works and
payments are covered within the scope of the =====loan agreement. Employer to
provide written evidence to this effect.
2.5 Conditions for the Performance Guarantee will not be extended
for the =====, but will apply to the original Contract Works only.
3.0 Special Conditions
3.1 Time for Completion has been amended as per 1.3 above, however
the Employer’s liabilities have not been concluded. Employer accepts to
instruct the Engineer to continue to evaluate all present and future variations
and claims by the Contractor in accordance with the Contract, in order to properly
assess the Employer’s liabilities.
3.2 Employer to indemnify the Contractor for any damage or defect to
the Contract works which are caused by the construction of the =====.
3.3 Standard nominated subcontract conditions are to be amended in
order for the subcontractor to be directly responsible to the Engineer for a)
Safety, b) Quality Issues, c) Testing, d) Documentation, e) Environmental
issues, f) Insurance of the works, and all issues pursuant to the Take Over of
the works by the Employer.
4.0 Exclusions
The following activities are specifically excluded from the cost and
programme of works:
4.1 Liaison and coordination with any Bulgarian Authority or body
who is, or maybe affected by the works.
4.2 Liaison and coordination with the public or any business or
enterprise who is, or maybe affected by the works.
4.3 Provision of any new external services required to the new
building
4.4 Any utility diversions required in order for the =====to be
converted.
4.5 Any support or temporary support to any structure (including
utilities) which may be affected by the =====.
4.6 Completion of any investigation works.
4.7 Any amendments required to the layout of beyond the =====,
including but not limited to; road layout, lighting, drainage, line marking,
street furniture, pedestrian walkways etc.
4.8 Hard and soft landscaping works; including the removal of any
existing .
4.9 Any temporary or permanent noise reduction measures required in
order to meet requirements.
4.10 Any additional works required in connection with geological
conditions which are not included within the Employers survey.
